Redbubble Challenges Official Rules
- AGREEMENT TO OFFICIAL RULES: By participating in this Challenge, entrants (also referred to as "you" or "your" or "yourself") fully and unconditionally agree to and accept these Official Rules and the decisions of the Sponsor (RedBubble Pty Ltd), which are final and binding in all matters related to the Challenge.
- ELIGIBILITY: This Challenge is open to all members of the RedBubble web-site and who have agreed to the terms of the RedBubble User Agreement. Employees (including non- employee workers), representatives and agents of RedBubble Pty Ltd, its subsidiaries and affiliates ("RedBubble"), Challenge prize partners and/or Challenge promotional partners, and their immediate families (spouse, parents, siblings, children, and those living in the same household) are ineligible to participate in this Challenge. This Challenge is subject to all federal, state, and local laws, rules and regulations and is void where prohibited by law.
- SPONSOR: This Challenge is sponsored and administered by RedBubble Pty Ltd, Level 3, 180 Flinders Street, Melbourne, Victoria, Australia.
- ENTRY DETAIL & PRIZES: Entry conditions, judging criteria and prizes for this challenge are detailed on the entry landing page. No substitution, exchange or transfer of prize by winners is permitted. Sponsor reserves the right to substitute any prize for one of equal or greater value. All entries must abide by the rules detailed in the challenging landing page.
- GENERAL CONDITIONS: This Challenge is conducted in English. In the event that the operation, security, or administration of this Challenge is impaired in any way for any reason, including, but not limited to, fraud, virus or other technical problems, the Sponsor may, in its sole discretion: (a) suspend this Challenge to address the impairment and then resume the Challenge in a manner that best conforms to the spirit of these Official Rules; (b) cancel this Challenge and award the prizes in a random drawing from among all eligible entries received up to the time of the impairment; or (c) cancel this Challenge and award no prizes. In the event of a dispute as to the identity of the entrant of any online entry, the 'authorized account holder' of the email address used to enter will be deemed to be the entrant. The 'authorized account holder' is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The Sponsor reserves the right, in its sole discretion, to disqualify any individual and/or entrant it finds to be tampering with the entry process or the operation of this Challenge or to be acting in violation of these Official Rules or any other promotion, in an unsportsmanlike or disruptive manner, or whose entry contains any inappropriate content, nudity, indecent acts, illegal drug use, illegal activities, or obscene gestures or situations. All entries must be, in Sponsor's sole discretion, suitable for presentation in a public forum. Any attempt by any person to undermine the legitimate operation of any part of this Challenge may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
- PUBLICITY: Except where prohibited, participation in this Contest constitutes entrant's consent for the Sponsor and the Sponsor's designees to use entrant's name, likeness, city and state/province of residence for promotional purposes in any media without further consideration. All information collected from entrants is subject to RedBubble’s Privacy Policy located at http://www.redbubble.com/privacy.
- RELEASE AND LIMITATIONS OF LIABILITY: Except where prohibited, by participating in this Challenge, entrants agree to release and hold harmless RedBubble Pty Ltd and its subsidiaries, affiliates, promotional partners, prize partners, providers and their respective agents and agencies, officers, directors, and employees (the "Released Parties") from and against any claim or cause of action (including, but not limited to, any potential third party infringement claims and breach of laws) arising out of participation in this Challenge or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in this Challenge; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of this Challenge or the processing of entries; (e) late, lost, or undeliverable mail or email; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in this Challenge or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in this Challenge and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages (other than for actual out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in this Challenge; provided that if it is not possible to award another entry due to discontinuance of this Challenge for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes for this Challenge will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes in this Challenge to be claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
- DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Challenge or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts of Victoria, Australia; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Challenge, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with this Challenge, shall be governed by, and construed in accordance with, the laws of the laws of the State of Victoria.
